By using our services you are agreeing to comply with and be bound by the following terms and conditions, which govern Statech’s relationship with you (The customer) in relation to our business. We reserve the right to change these terms and conditions without prior notice.
The term ‘Statech’ or ‘us’ or ‘we’ refers to the owner of the website whose office is Park Road, Coalville, Leicestershire LE67 3AE.
The term ‘you’ refers to the user or viewer of our website.
The use of this website is subject to the following terms of use:
- The content of the pages of this website is for your general information and use only. It is subject to change without notice.
- Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
- Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific requirements.
- This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.
- All trademarks reproduced in this website, which are not the property of, or licensed to the operator, are acknowledged on the website.
- Unauthorised use of this website may give rise to a claim for damages and/or be a criminal offence.
- You may not create a link to this website from another website or document without Statech’s prior written consent.
- Your use of this website and any dispute arising out of such use of the website is subject to the laws of England, Scotland and Wales.
Terms of Services:
Payments - Statech issue all clients with invoices for any outstanding amount on their account, these payments must be made before the calendar years end, failure to pay within the allotted time period will result in a 12% administration fee and another 5% for each additional month overdue thereafter. In conjunction to late payments a client’s website may be suspended and so will not be visible online. Ownership of any goods will not be transferred over to the client until full payment is made, however payment will be accepted at time of delivery of these goods.
Domain Names - Statech will work with clients to manage domain names under the ICANN laws, this meaning we will NOT register a domain name under the name of Statech and all domain names must be registered under the clients own business or personal name and address. Statech will pay for a domain name renewal should they be using the web design and hosting services at full price. Statech reserve the right to refuse a renewal payment should they feel these terms are not being met.
Statech do not hold any responsibility over a customer’s domain name and will not accept any liability for domain names expiring. The domain name is registered under a clients name and therefore remains the soul responsibility of the client. Statech will not claim any responsibility for loss of or damage to any domain names.
Hosting - Our server has a 99.9% uptime, however in the event that the server does crash or go offline we can assure you that all your data is still backup and secure. In the event that the server goes down your website will not be accessible to anyone, including yourself, until the server is back online. Downtown is generally around 2-hours. We ask that you report any downtime you encounter as most the time this is a fault on the users system and not actually our server. In this case we will advise on how to fix your system fault.
Web Design - Statech will design your website for you based on the package or service you have requested and paid for. Should a client require more than the current package or service offers they will be liable to pay the difference to make up the cost of the upgrade. Statech reserve the right to change these prices at any time and clients wishing to upgrade a service or package will be liable to pay the difference on the new price structure.
All Statech clients are provided with an administration login to the content management system and so will have the ability to update their own website; Statech holds no responsibility for content in the form of words, images, animations or clips added to a client’s website via this method. Clients are entrusted with their own login details and should keep this information secure and should not pass it on. If such information is passed on to another or if this information is acquired from another source Statech will hold no responsibility for damages made to the website.
Statech reserve the right to remove a clients website from all forms of portfolios should we deem the website to hold incorrect, illegal or inappropriate content of any sort. This includes; Profanity, Pornography, Illegal Activity, Sales of Drugs (Unless approved by Statech), Spamming. We also reserve the right to remove the website from all forms of our portfolio should we feel that the website will be detrimental to our business, this also includes designs that are outdated and/or not up to our standards. This also applies for Clients updating the website themselves.
Data Back up - Statech will happily receive your electronic files via email, however we only keep a copy of these files during the web design process, after which these files are deleted from our hard drive as they will be online on your web space. We strongly remind all clients that they are responsible for their own media and should always keep a backup of such data. If the client loses the media Statech hold no responsibility for having a backup copy of the media for the client. We also do not hold any responsibility for loss of media due to a website renewal (Complete remove and redesign). Client should be responsible for their own media and always keep a backup.
Search Engine Optimisation - Statech provide this service for free. At no point do we suggest that we can guarantee that you will be placed at the top of any search engines nor can we promise that you will remain there permanently. Statech hold no responsibility for a website losing rankings in search engines due to changes in the functionality of said search engine. We reserve the right to refuse to perform Search Engine Optimisation immediately on any and all client website due to high demand of our services however we will endeavour to perform Optimisation of your website as soon as we can. Our Search Engine Optimisation services are a kind gesture and will not be provided unless Statech wish to perform such tasks.
Update Requests - Statech remind all clients that updates are a free service as part of an ongoing relationship, as this service is free we reserve the right to withdraw this service if we feel that it is being abused or that a client is abusing our time for minor changes. All clients are issued with their own login accounts with full administrations right to edit the website themselves. This being the case customer is encouraged to perform their own updates for immediate results. Requests sent to Statech can take up to 7-Days to process pending on staff availability. Statech do not accept inappropriate content on our client’s websites, if a client requests that material is placed on the website that we deem as inappropriate your request will be rejected. If a customer chooses to place this content on the website themselves we will not remove it, however we reserve the right to remove you from our portfolio and severe all links of advertising to your website.
Refunds - Clients are asked to pay for any services provided by Statech after the work has been done, by the passing of money the client is agreeing that they are happy with the service. Should the client then encounter problems Statech will hold no liability as the customer should have checked all aspects of the service before the passing of funds. Statech deem the passing of money, in all forms, as a binding contract of satisfaction.
The only exception to this rule is a hosting fee, Should the customer pay for hosting in advance and cancel the service before the time of cover has expired, they will be entitled to a refund of the credited amount. Cover for hosting of one month will not be refunded, if the date resides within the month of the cover client will not be entitled to receive a refund. For example: If a client pays for hosting for June in May and then wishes to cancel on 2nd of June, they will not be entitled to a refund as the cover has already begun.
Cancellations - Statech provide a 30-day money back guarantee on web design, this means should you not be completely happy with the results within 30-days you will be able to cancel and a refund issued. You will be asked for a reason as to why you are cancelling and should your reason be for matters out of our control we reserve the right refuse a refund. Other cancellation can be requested at any other time however no refunds will be made on work we have currently carried out and any outstanding invoice will be paid in full by the client.
Holidays / Opening Hours - Statech are always available to take requests or communications. However Statech do not process any requests or work on public holidays. Statech officially shuts down for the end of the year as of the second Sunday in December and opens again the second Sunday in January of each year. During this time we will process any outstanding requests and updates. Any update requests sent after the second Sunday in December will not be processed until we reopen in January.
